Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of Burgondy at burgondy.com ("Service"), operated by Myoats LLC ("we", "us", "Company"). Our Privacy Policy also governs your use of the Service and explains how we collect, safeguard, and disclose information. Together they form your agreement with us.
By accessing or using the Service you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree, you may not use the Service.
2. What the Service does
Burgondy scores a resume against a job description and suggests rewrites using artificial intelligence. It is a writing and formatting tool.
The Service does not find you work, does not apply to jobs for you, and does not guarantee any interview, response, or hiring outcome. No result is promised.
3. No use by minors
The Service is intended only for individuals at least eighteen (18) years old. By using the Service you represent that you are at least eighteen and have the authority to enter into these Terms.
4. Accounts
You sign in with a third party identity provider. You are responsible for all activity that occurs under your account, and for keeping access to it secure. You must tell us promptly if you believe your account has been used without your permission.
Account integrity
You may not provide false, misleading, or impersonated account information. You may not create or use multiple, duplicate, or related accounts to evade usage limits, credit limits, restrictions, or other enforcement.
Violations may result in restriction, suspension, or permanent termination of your account and of any related accounts. For abuse prevention reasons we may decline to share the details behind such decisions.
5. Communications
We may send you messages necessary to operate your account, such as billing receipts, payment failures, and important changes to the Service. These are not marketing and you cannot opt out of them while you hold an account. If we ever send optional product or marketing email, it will include a way to unsubscribe.
6. Credits
Use of the Service consumes credits. Actions that call the AI, including scoring and optimizing, spend credits.
- Free accounts receive a one-time grant of credits. This grant is intended to be available once per person. We may limit, withhold, or reclaim free credits where we believe someone is creating additional accounts to obtain them repeatedly.
- Paid plans include a monthly allowance of credits. Current plans, prices, and allowances are shown on our pricing page.
- Credits do not roll over. Unused credits expire at the end of the billing month and have no cash value.
7. Subscriptions and billing
Parts of the Service are billed on a monthly subscription. You are billed in advance for each billing cycle, and your subscription renews automatically on the same terms until it is cancelled.
Payments are processed by a third party payment provider. By subscribing you authorize recurring charges to your chosen payment method. You represent that you are permitted to use that payment method and that the information you give is accurate.
Cancelling
You may cancel at any time from your account page. Access continues until the end of the billing month you have already paid for, after which the account moves to the free plan. Your saved work remains in your account.
Failed payments
If a payment fails we may retry it. Access may continue during that period. If payment ultimately fails, the account moves to the free plan.
Fee changes
We may change subscription fees. Any change takes effect at the end of the then current billing cycle, and we will give reasonable notice beforehand so you can cancel before it applies. Continuing to use the Service after a fee change takes effect constitutes agreement to the new fee.
8. Refunds
Except where required by law, subscription fees already paid are non-refundable, including for partial months and unused credits.
9. Your content
You retain ownership of the resumes, job descriptions, answers, and other material you submit ("Content"), and of the output the Service generates for you.
You grant us the limited right to store, process, and transmit your Content as necessary to operate the Service. This includes sending your resume and job description to Anthropic, our AI provider, for processing, as described in the Privacy Policy. We do not use your Content for advertising, we do not sell it, and we do not share it with employers, recruiters, or job boards.
You represent that your Content is yours to submit, and that submitting it does not violate the rights of any other person. Do not upload another person's personal information without their permission.
10. Accuracy and the limits of AI
AI output can be incorrect. Scores are estimates, not a prediction of how any employer or applicant tracking system will treat your resume.
You are responsible for reviewing everything before you use it, and for the final contents of your resume, including every factual claim it makes about your experience, education, and qualifications.
11. Prohibited uses
You may use the Service only for lawful purposes. You agree not to:
- Fabricate qualifications, employment history, education, or credentials.
- Use the Service in a way that violates any applicable law or regulation.
- Impersonate any person or entity, or misrepresent your affiliation.
- Infringe the rights of others, or act fraudulently or harmfully.
- Scrape, crawl, harvest, extract, index, cache, mirror, or otherwise systematically collect data or content from the Service, whether by automated browsing, scripts, agents, bots, crawlers, or similar means.
- Use the Service, or any data or content from it, to train, fine-tune, evaluate, benchmark, or otherwise develop any artificial intelligence or machine learning system, without our prior written consent.
- Use any automated system or non-human process to create accounts, sign in, consume usage limits, or otherwise use the Service without our prior written consent.
- Disable, overburden, damage, or impair the Service, or interfere with anyone else's use of it.
- Introduce viruses, worms, or other malicious or technologically harmful material.
- Attempt to gain unauthorized access to the Service, its servers, or any connected system, or conduct a denial of service attack.
- Reverse engineer, resell, or redistribute the Service.
12. Intellectual property
The Service and its original content, features, and functionality, excluding Content provided by users, are and remain the exclusive property of Myoats LLC and its licensors, and are protected by copyright, trademark, and other laws. Our name and branding may not be used without our prior written consent.
13. Copyright claims
We respect the intellectual property rights of others. If you believe material on the Service infringes your copyright, contact us by email with the subject line "Copyright Infringement" and include a description of the work, the location of the material you say is infringing, your contact details, a statement of good faith belief, and a statement made under penalty of perjury that your notice is accurate and that you are authorized to act.
14. Third party services and links
The Service relies on third parties, including for sign-in, AI processing, hosting, and payments, and may link to sites we do not control. We are not responsible for the content, policies, or practices of any third party, and we encourage you to review their terms.
15. Disclaimer of warranty
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
COMPANY DOES NOT WARRANT THAT THE SERVICE OR ITS OUTPUT WILL BE ACCURATE, RELIABLE, ERROR FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE WILL MEET YOUR NEEDS OR EXPECTATIONS. THE FOREGOING DOES NOT AFFECT ANY WARRANTY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
16. Limitation of liability
EXCEPT AS PROHIBITED BY LAW, COMPANY AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, HOWEVER ARISING, INCLUDING LOST JOB OPPORTUNITIES, LOST EARNINGS, OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EXCEPT AS PROHIBITED BY LAW, COMPANY'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
17. Termination
We may suspend or terminate your account and access to the Service at our discretion, without prior notice, including for breach of these Terms. You may stop using the Service at any time, and may ask us to delete your account.
Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.
18. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it.
19. Changes to the Service
We may change, restrict, or withdraw the Service or any part of it at our discretion, and we will not be liable if any part of it is unavailable at any time.
20. Amendments to these Terms
We may amend these Terms by posting the amended version on this page and updating the date above. Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not agree to them, you are no longer authorized to use the Service.

BY USING THE SERVICE YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
